Terms of Use for Zabaan Sambhal Ke

Welcome to Zabaan Sambhal Ke! These Terms of Use (“Terms”) govern your access to and use of our mobile application (the “App”). Please read these Terms carefully before using the App.

By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

1. License to Use the App

Subject to your compliance with these Terms, Mocodo LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the App on a mobile device you own or control for your personal, non-commercial entertainment purposes.

You must be at least 13 years old, or the minimum age required in your country, to use the App.

2. In-App Purchases

The core functionality of the App is free. Optional features, such as the “Card Editor,” are offered as one-time in-app purchases (“IAPs”).

Payment processing: All IAP transactions are processed by the store from which you downloaded the App (for example, Apple App Store or Google Play). You agree to follow that store’s terms. Mocodo LLC never receives your payment details.
No refunds: All purchases are final and non-refundable except as required by law or the store’s policies.
Price changes: Prices may change without notice.

3. User-Generated Content (UGC)

The Card Editor lets you create, edit, and store custom decks and cards (“User-Generated Content” or “UGC”).

Your responsibility: You alone are responsible for your UGC. You warrant that you have the necessary rights to it and that it does not violate any law or third-party rights.
Prohibited content: You will not create UGC that is illegal, hateful, defamatory, obscene, discriminatory, sexually explicit, infringing, or harassing.
Reporting: To report objectionable UGC, email appsupport@mocodo.llc.
License grant: By creating UGC you grant Mocodo LLC a non-exclusive, royalty-free, worldwide license to use and display that content solely to operate the App. You may revoke this license by deleting your UGC.
No obligation to monitor: We are not obligated to monitor UGC, but we may remove any content that violates these Terms.

A. No ownership transfer: You retain all ownership rights in your UGC. Mocodo LLC does not acquire title or ownership in it.

B. No endorsement or responsibility: Mocodo LLC does not endorse or assume liability for UGC, including content that may be unlawful or offensive. You bear sole liability for any claim arising from your UGC inside or outside the App.

C. Indemnity: You agree to indemnify, defend, and hold harmless Mocodo LLC and its affiliates from any claims, damages, or expenses (including reasonable attorneys’ fees) related to your UGC or your breach of this Section 3.

4. Prohibited Conduct

Use the App for any unlawful or unauthorized purpose.
Reverse-engineer, decompile, or attempt to extract the App’s source code, or circumvent any technological protection measures.
Interfere with or disrupt the App’s integrity or performance.
Harass, abuse, or harm another person through the App.
Sell, rent, lease, or sublicense the App or your access to it.

5. Intellectual Property

The App and all original content (excluding UGC) – including the Zabaan Sambhal Ke name, logo, visual design, default decks, features, and functionality – are the exclusive property of Mocodo LLC and its licensors and are protected by copyright, trademark, and other laws.

6. Termination

We may suspend or terminate your access to the App at any time without notice if you breach these Terms. You may terminate this agreement by uninstalling the App.

Sections 3 (A-C), 4, 5, 7, 8, and this sentence survive termination.

7. Disclaimer of Warranties and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MOCODO LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOCODO LLC AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLES, ARISING FROM YOUR USE OF THE APP.

8. Governing Law and Venue

These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict-of-law rules. You and Mocodo LLC agree that the state and federal courts located in Johnson County, Kansas have exclusive jurisdiction over any dispute arising under these Terms.

9. Changes to Terms

We may modify these Terms at any time. If a change is material we will give at least 30 days’ notice before it takes effect. Your continued use of the App after the effective date of revised Terms constitutes acceptance.
